Terms of service

The agreement between you and SVAMAI covering the website, Osdent, 1Dentist and our APIs.

Agreement

These terms govern your use of svamai.in, the Osdent and 1Dentist applications, and any SVAMAI API. By creating an account or using the services you accept them. Enterprise customers may hold a separate signed agreement, which takes precedence where it conflicts.

Not a medical service

SVAMAI is a technology provider. We do not practise medicine or dentistry, do not diagnose, and do not provide treatment. Clinical decisions are made solely by the registered clinician using our software, who is responsible for the care they deliver. Nothing in our products, including AI-generated drafts, constitutes medical advice.

Emergencies

The services are not for medical emergencies. If you are experiencing one, contact local emergency services or attend a hospital immediately.

Your account

  • Give accurate information and keep it current.
  • Clinicians must hold valid registration with their state dental council and must not misrepresent their qualifications.
  • Keep credentials confidential; you are responsible for activity under your account.
  • Do not share a login between people — add users with their own scoped access instead.

Acceptable use

  • Do not access records you are not authorised to see.
  • Do not upload unlawful, infringing or malicious content.
  • Do not scrape, reverse engineer or attempt to bypass access controls.
  • Do not use the services to send unsolicited marketing to patients.
  • Do not resell the services without a written partner agreement.

Clinical records and ownership

You retain all rights in the content you create. Patients own their clinical record; the treating clinic is its custodian. We claim no ownership over clinical data and process it only to provide the services. You may export your data at any time from within the product.

Fees

Free plans are free, with no time limit and no card required. Paid plans are billed in advance in Indian rupees, exclusive of applicable taxes, and renew unless cancelled before the renewal date. Fees already paid are non-refundable except where required by law. We give at least thirty days’ notice before a price change affecting an existing subscription.

Availability

We target 99.9% monthly availability excluding scheduled maintenance, which we announce in advance. Enterprise agreements may include a contractual service level with remedies. We may modify or discontinue features, and we will give reasonable notice and an export path where a change is material.

Third-party services

The services depend on third parties including cloud hosting, payment gateways, and messaging providers. Their terms apply to their portion of the service, and we are not liable for their acts or omissions beyond our own duty of reasonable care in selecting and supervising them.

Suspension and termination

You may close your account at any time. We may suspend an account for non-payment, breach of these terms, or where continued use presents a security or legal risk, giving notice where lawful and practicable. On termination we make your data available for export for at least thirty days before deletion.

Liability

To the maximum extent permitted by law, SVAMAI is not liable for indirect, incidental or consequential loss, or for loss of profit, goodwill or data. Our aggregate liability in any twelve-month period is limited to the fees you paid us in that period, or ₹10,000 where you paid nothing. Nothing here limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of India. The courts at Lucknow, Uttar Pradesh have exclusive jurisdiction, and we will attempt good-faith resolution before either party commences proceedings.
